Timeline for Federal Court of Appeal Emergencies Act
Timeline for the presentation of materials and trial scheduling
This is the appeal from the decision of Justice Mosely declaring the enforcing of the Emergencies Act to be unreasonable, not justifiable, illegal and unconstitutional. I had submitted evidence and a request to be heard as an intervener.
My evidence was primarily communication with and about the Minister of Justice and his failure to do his duty, and the failure of the AG’s department to respond to a Constitutional Question on the failure to respond to the Enforcement Procedure of the Charter
“24. (1) Anyone whose rights or freedoms, as guaranteed by this Charter, have been infringed or denied may apply to a court of competent jurisdiction to obtain such remedy as the court considers appropriate and just in the circumstances.”
and the Court of competent jurisdiction to judge the Judiciary is Parliament.
These are the links to the summaries of the submissions.

The Court dismissed my intervener application but did read the evidence and so the communication is before the Court which was the important part. We only have control over our own conduct. What others do, is up to them. And their Duty.
The Court made comment on the materials, delivery and scheduling of the final hearing.
Delay is the first thing to note.
nothing terribly exciting.
A hearing date is to be set prior to October 25th, 2024 presumably in November 2024 but prior to Christmas, one would expect. We shall wait and see what evidence is submitted in the meantime. I will report again as the evidence becomes available.
One would assume that if the AGC loses again, they will appeal to the Supreme Court of Canada, on which the Liberal Party has appointed a majority of the Judges but would that appeal happen before an election?
The parallels with the situation down in the USA are stunning. I included in my submissions the reporting of the allegedly illegal conduct of David Lametti to the RCMP National Division tasked with investigating corruption by members of Parliament whom I was corresponding with on Jan 6th 2022 as protesters there were storming the Capitol Building. The Prime Minister’s Office was also informed and forwarded the problem to the Minister of Public Safety, Marco Mendocino, who never responded.
The allegations include attempts to subvert democracy, foreign interference, allegations of corruption, dictatorships and the politicization of the legal system both prosecutorial and judicial.
